PAIA Manual

This manual is published under section 51 of the Promotion of Access to Information Act 2 of 2000(“PAIA”), as amended by the Protection of Personal Information Act 4 of 2013 (“POPIA”). It explains what records we hold and how to ask for access to them.

2. The PAIA Guide

The Information Regulator has compiled a guide, in terms of section 10 of PAIA, on how to use the Act. It is available from the Regulator in all official languages, free of charge:

3. Records available without a formal request

Some records are published and need no request at all. These include our Terms of Use, our Privacy Notice, this manual, and every published property listing on xp24.co.za. If you are a registered user, the record of your own listings and payments is available to you in the XP24 app, or on request at no charge.

We have not published a notice under section 52(2) of PAIA, and no records are automatically available for inspection or purchase under that section.

4. Categories of records we hold

  • Listings: property details, descriptions, photographs, video, floorplans and publication history.
  • Seller records: name, contact details, ID number, marital status, how the property is owned, and any ownership documents supplied.
  • Enquiries and leads: the name, contact details and message of anyone enquiring about a property.
  • Payments: transaction confirmations and invoices from our payment provider. We do not hold card numbers.
  • Consents and notices: what was agreed, which version of these documents applied, and when.
  • Company records: statutory, financial, tax and employment records, and our contracts with service providers.
  • Technical records: system, security and access logs.

5. Processing of personal information (POPIA)

The purposes for which we process personal information, the categories of data subjects, the recipients we share it with, any cross-border transfer, and our security safeguards are all set out in our Privacy Notice, which forms part of this manual. In summary: we process information about sellers, buyers and enquirers, and our own personnel and suppliers, in order to advertise property, confirm that a seller is entitled to sell, pass on enquiries, take payment and keep proper records. Our database is hosted in the European Union, which is a cross-border transfer under POPIA section 72.

6. How to request a record

  1. Complete Form 2 (Request for Access to Record), prescribed under the PAIA Regulations and available from inforegulator.org.za.
  2. Send it to the Information Officer at info@xp24.co.za, or to the address in section 1.
  3. Give enough detail to identify the record and yourself, state the form of access you want, and give a contact address. If you are asking on someone else's behalf, include proof of your authority.
  4. Say which right you are seeking to exercise or protect, and why the record is required to do so — PAIA section 50(1)(a) requires this for a private body.

We will decide within 30 days and tell you in writing. That period may be extended by a further 30 days in the circumstances PAIA allows, and we will tell you if it is. If we refuse, we will give reasons and explain your right to complain to the Information Regulator or to apply to a court.

7. Fees

PAIA allows a request fee and an access fee, at the rates prescribed in the Regulations. There is no fee where you are requesting a record of your own personal information. Where a fee does apply, we will tell you the amount before doing the work, and you may appeal it.

8. Grounds for refusing access

We must refuse a request in the circumstances set out in Chapter 4 of Part 3 of PAIA — principally where granting it would unreasonably disclose someone else's personal information (s63), harm the commercial interests of a third party or of ourselves (s64 and s68), breach a duty of confidence (s65), or disclose privileged or research information (s67 and s69).

10. Availability and updates

This manual is available free of charge on this page, and on request by email in an alternative format. It is reviewed when our records or processing change, and the current version and effective date always appear at the top.
